OPENPOINT Membership Terms & Conditions


Applicant hereby agrees with the following terms and conditions:
1. Recognition and Acceptance Clauses
OPENPOINT Member Service (hereinafter referred to as the “Member Service”) is established and provided by President Chain Store Corporation (hereinafter referred to as “the Company”). When you complete the OPENPOINT membership registration procedure, or start to use the Member Service, it shall mean that you have read, understood, and agreed to accept all of the contents of the terms and conditions of the Member Service. The purpose of the terms and conditions is to protect the interests of the Member Service provider and all users, which also constitutes an agreement between the user and the Member Service provider. For any revision or change of the content of this agreement, the Company may publish announcement on the OPENPOINT website and APP service. We recommend you be aware of such revision or change at any time. When you continue to use the Member Service after the aforementioned revision or change of the content, it is deemed that you have read, understood, and accepted such revision and change of the content. If you are a minor under the age of twenty years old, your parent (or guardian) is required to read, understand, and agree to all contents and subsequent revisions and changes of this agreement in order to proceed with the membership registration and to use or continue to use the Member Service. When you use or continue to use OPENPOINT Service, it is presumed that the parent (or guardian) of the member has read, understood, and agreed to accept all contents and subsequent revisions and changes of this agreement.
2. Member Registration Obligation
To use the Member Service, you agree with the following:
During the registration of the Member Service, you are required to provide your correct and latest information, without any forgery or alternation of information for repetitive registration, etc.

You are required to maintain and update the accuracy of your personal information, in order to obtain the most optimal service.

If you provide any incorrect or deceptive information, or fail to provide information according to the instruction, or necessary information is missing, OPENPOINT shall have the right to suspend or terminate your account without prior notice, and may also refuse your use of all or a portion of the Member Service.
3. Member Service
After the Company completes and verifies the member’s application, service is then provided to the member according to the service, item, content, status, and function established for the system at that time. The Company reserves the right to make any addition, reduction, or change of all or a portion of the service, item, content, and function at any time, without individual notices.

A portion of the service and item may be established or provided by an affiliate or cooperating partner of the Company, such that members may be required to perform application or registration procedure individually, or members may be required to pay a fee, and members shall follow the instructions and relevant pages provided for such service and item at that time and subsequent revisions thereof.

The Company reserves the right to change a free service to a charged service, and the right to change the fee collection standard. The content after the change is to be announced and published on relevant webpages or the APP without individual notices.

A portion of the Member Service may be established with relevant use rules or agreements, and members shall comply with the use rules and relevant agreements established for the service or item.

The Company may actively, or according to member subscription, send various electronic newsletters to members regularly or irregularly. In the case where a member does not wish to receive the member electronic newsletter, the member is requested to cancel the subscription at the OPENPOINT website > Member Center.
4. Personal Data Protection
Your personal data and other specific data (such as transaction data) registered or saved is protected and regulated according to the OPENPOINT “Privacy Policy”. To provide comprehensive and diverse services and products, OPENPOINT may collect your basic information and account information according to the necessity of the service provided. In addition, service is provided, or a product is sold according to the purpose of use authorized by you during the provision of your data. You agree that the Company and the Company’s relevant business cooperating partners (including relevant performance assistants and agents) and the relevant enterprises of Uni-President Group, for specific purposes (such as: under the premise of protecting the rights and interests of members or not damaging the rights and interests of members) and within the scope (for OP service only), to exchange and use, and within the scope of the purpose of providing the Member Service marking, market analysis, statistics, or research or providing personalized service or value-added service to members, to record, save, and use your data or records saved or generated during your use of the Member Service, or to provide marketing activities according to your needs and relevant special offer information to you. OPENPOINT will continue to use the personal data provided by you until you have submitted a request to stop such use or until the date when OPENPOINT terminates the provision of service. The area of use of your personal data shall be limited to the region of Taiwan only.
Except for the regulatory requirements of the law, or due to requests made by the judicial authority or other agencies with authority according to the legal procedures, or for the purpose of protecting the legitimate rights and interests of other members or a third party, protecting normal operation of the Member Service system, entrusting a third party to handle service provision related matters, or engaging in further agreement with you via a contract or electronic document for the Member Service, such that there is a need to disclose your data to a third party, your data will not be disclosed or provided to any other third party for use. According to your verifiable identification document application submitted by you, OPENPOINT agrees to provide your personal data file preserved by the Company or to provide response and inquiry, or to allow reading or to prepare a duplicate copy of your personal data file within thirty days. In the event that you entrust others to act as a proxy to submit the application, please provide additional verifiable identification document for review and approval. If you apply for inquiry or request for review your personal information or preparation of a duplicate copy, the Company may collect a certain service charge. The service charge shall be handled according to the standard specified by the Company. If the Company cannot process your application within thirty days, the Company will issue a written or electronic document to inform you the reason thereof. You may also log in to the “official website and APP” provided by the Company with your account and password, in order to review your personal data file online at any time. In the case where you entrust others to act a proxy for login, you are required to bear full liability. In the case of any change to your personal data, you may correct your personal data on the OPENPOINT website and APP individually. If you do not wish to provide your data to OPENPOINT, OPENPOINT Alliance Enterprises, and contracted cooperating stores for continuous use of your data, you may also send a letter to the Member Service Center, and we will stop the use of your data or will delete your data (once member data is deleted, it shall be deemed that the member abandons all point returns and rebates without any further recovery). You may freely choose the extent of the personal information provided; however, in the case where the information provided is insufficient or contains errors, the complete service of the Member Service may not be provided.

In the case of the following conditions, the Company may review or provide personal data or related telecommunication data of members to relevant government authorities or to a third party claiming infringement of rights with appropriate proof:
  1. Where compliance with regulatory requirements, or orders of judicial authority or other relevant government authorities must be made;
  2. Where the member violates laws, infringes the rights and interests of a third party, or violates these terms of use or any terms and conditions of use or agreements;
  3. Where the security of the Member Service system or the legitimate rights and interests of the operator must be protected;
  4. Where the legitimate rights and interests of other users or other third parties must be protected;
  5. Where the normal operation of this system must be protected.
When you use relevant services provided by OPENPOINT, it shall mean that you agree with this Privacy Policy. For the complete content of the Privacy Policy, please refer to the announcement of “OPENPOINT Personal Data Notice Terms and Conditions”.
5. Member Account, Password and Security
After the registration procedure of the Member Service is complete, you will receive a specific password and member account. You must maintain the confidentiality and security of the password and account. When the member account and password inputted according to the system specified method are consistent with the login data, regardless of whether it is inputted by you in person, it shall be deemed to be used by the member in purpose. You are required to bear the full liability for all actions performed with the use of the password and account. You also agree with the following:

  • Members may self-choose their own username and password individually; however, members shall bear the obligation for the safekeeping and confidentiality of their own username and password without disclosing or providing it to any third party. For actions in relation to the use of the Member Service performed with the specific username and password and all actions after logging in the system, the member possessing the username and password shall bear the liability for such actions.
  • Your account, password, and member rights and interests are provided for your personal use and utilization only, which shall not be lent, transferred to others, or used jointly with others.
  • In the case of a stolen account and password, improper use, or other conditions where OPENPOINT cannot identify whether the account is used by you in person, OPENPOINT shall not be obligated to bear any liabilities for damages suffered by you due to such matter.
  • Where a member discovers or suspects his/her username and password are misused or improperly used by a third party, the member shall inform the Company immediately, in order to facilitate the Company to adopt appropriate response measures in a timely manner. However, the aforementioned response measures shall not be interpreted as the Company, explicitly or implicitly, bears the obligation of indemnification or compensation in any form for such member.
6. Protection for Children and Teenagers
To protect the network use security for children and teenagers, in the case where the content of a webpage indicates the restricted rating for users, parents (or guardians) shall ensure that the content is not browsed by any children and teenagers under the age of 18 years old. If the content of a webpage is not classified under the restricted rating, it is still recommended that parents, guardians, and other personnel providing actual care to children and teenagers shall provide guidance on the browsing of such content.
7. User’s Obligation and Commitment to Legal Compliance
You guarantee to not use the Member Service for any illegal purposes or in any illegal ways, and also guarantee to comply with all relevant local laws and all international practices for the use of internet network. If you are a user outside the local jurisdiction, you shall also agree to comply with the laws of the country or region where you are located. You agree and guarantee to not use the Member Service to conduct any actions infringing the rights and benefits of others or any illegal actions, including but not limited to:

  • Publish or transmit any scandalous, insulting, threatening, offensive, inappropriate, indecent, deceptive content, texts, images, or any form of files violating the public order or good morals or other illegal contents.
  • Infringe or damage the reputation, privacy, trade secrets, trademark rights, copyrights, patent rights, other intellectual property rights and other rights of OPENPOINT and others.
  • Violate the non-disclosure obligation required to be borne according to the laws or contracts.
  • Impersonate the name of others to use the Member Service.
  • Transmit or spread a computer virus.
  • Engage in business actions without prior authorization of OPENPOINT.
  • Publish, transmit, send junk mail, chain letters, and transmit multi-layer messages or advertisements illegally or without the permission of OPENPOINT; or store any data violating the intellectual property rights of others or in violation of the laws.
  • Engage in any repulsive actions causing disturbance, unpleasant or violating general internet etiquette to other users or third party of the Member Service.
  • Other actions noncompliant with the purpose of use provided by the Member Service or actions considered by OPENPOINT, based on proper grounds, to be inappropriate.
8. OPENPOINT may add, modify, or terminate relevant activities according to the actual implementation status, and may also choose the most appropriate method to inform members.
9. In the case of any one of the following conditions, OPENPOINT shall have the right to stop or interrupt the provision of the Member Service:
  • Where there is a need to perform necessary maintenance and construction of the electronic telecommunication equipment of the OPENPOINT website.
  • Where accidental or unexpected malfunction of electronic telecommunication equipment occurs.
  • Where the electronic telecommunication service application of the OPENPOINT website is stopped due to any causes such that the service cannot be provided.
  • Due to force majeure factors of natural calamities or other matters not attributable to OPENPOINT, such that OPENPOINT cannot provide service.
10. Presentation Method of Electronic Documents
You agree that during the use the Member Service, the expression for all transaction may be made in the form of electronic documents as the presentation method. When you click the function key of “Agree” or “Confirm” (or “OK”) on each service and function page, it shall be considered as an official expression of intent made by you.
11. Protection of Intellectual Property Rights
For the software or programs used by OPENPOINT, all contents in the Member Service, including but not limited to works, images, files, information, data, service architecture, and arrangement of service screen and webpage design, OPENPOINT or other rightful owners shall own the intellectual property rights, including but not limited to trademark rights, patent rights, copyrights, trade secrets, and know-how, etc., according to the laws. An individual shall not use, modify, reproduce, broadcast publicly, alter, distribute, issue, announce publicly, perform reverse engineering, decoding or disassembly arbitrarily. If you wish to cite or quote the aforementioned software, program, or service content, you shall obtain the prior written consent of OPENPOINT or other rightful owners according to the laws. It is your obligation to respect intellectual property rights. In the case of any violation, you shall bear the damage indemnification (including but not limited to litigation fees and attorney fees, etc.) for OPENPOINT.

Under the principle of respecting the intellectual property rights of others, members agree that during the use of the service of OPENPOINT, they shall not engage in any actions infringing the intellectual property rights of others.

If a member is involved in an infringement matter, OPENPOINT may suspend all or a portion of the service, or may adopt the handling method of canceling the account of such member.

In the case of discovery of infringement of intellectual property rights, please submit the status of infringement and contact method along with the description of facts as well as the declaration on the legitimate ownership of the intellectual property rights to the Company. 12. Your Authorization to OPENPOINT
For the personal data and use records registered or saved by members, members agree that OPENPOINT and the Company, as well as relevant enterprises of the Uni-President Group, during the provision of the Member Service, may collect, process, preserve, transmit, and use such data within the scope agreed by you, in order to provide other information or service to users, or to use it for member statistical data, or to perform surveys or research related to network behaviors, or any legal uses. In the case where you have no legal rights to authorize others to use, modify, reproduce, publicly broadcast, adapt, distribute, issue, publicly announce certain information, and sub-license the aforementioned rights to a third party, please do not arbitrarily upload, transmit, input, or provide such information to OPENPOINT. You shall also guarantee that the use, modification, reproduction, public broadcast, adaption, distribution, issuance, public announcement, and sub-license of such information conducted by OPENPOINT and the Company, as well as relevant enterprises of Uni-President Group, do not infringe the intellectual property rights of any third party; otherwise, you agree to bear the damage indemnification liability (including but not limited to litigation fees and attorney fees, etc.) for OPENPOINT. For all program design, interface, URL, trademark or logo, computer program, and database, etc. provided by the Member Service, the trademarks, copy rights, other intellectual property rights, and data ownership, etc. shall be owned by the Company or rightful owners authorizing the Company for use thereof.

Members agree to authorize the Company and relevant enterprises of Uni-President Group to save and publish information on services or items, and on the service page, to adopt methods considered to be appropriate by the Company, including preparation or conversion of various different versions or formats for different software or hardware equipment, such as versions suitable for online reading, and different versions or formats available for download by different computers or smartphone equipment (including smart mobile phones, any tablets equipped with IOS or ANDROID, PDA and similar equipment developed in the market in the future), in order to allow specific or non-specific users to view, inquire, search online, or to read or receive information offline. Members also agree to authorize the Company to self-select works and data previously uploaded, published, and saved in the Member Service by the members, and to independently publish, summarize, or combine with the works and data of other members in order to release electronic newsletter or similar electronic information, including but not limited to the use of such works and data for the transmission of electronic newsletters and relevant information for the marketing or promotion purpose of the Company and the Member Service.
13. Special Authorization
Since the use of the internet transactions or activities provided by the Member Service may require delivery or transportation operators to complete the delivery or retrieval of products (or gifts, etc.), consequently, you agree and authorize OPENPOINT to provide personal data (such as recipient’s name, delivery address, contact telephone, etc.) provided by you and necessary for the delivery to the delivery or transportation operators depending upon the needs and purpose of such internet transaction or activity, in order to facilitate the completion of the delivery or retrieval of the current products (or gifts, etc.). For the remaining provisions related to the use or processing of your personal data, please refer to the “Personal Data Use Terms and Conditions”.
14. Rejection or Termination of Your Use
You agree that OPENPOINT may, based on the consideration of protecting transaction security and any grounds, including but not limited to the repetitive registration, incorrect or false information, intentional impersonation of names of others, infringement of the right to name of others, exclusive right to company name, trademark rights or other intellectual property rights, or violation of public order and good morals, government laws, abuse of rights, violation of principle of ethics, or damage of the service principles of the Company, the Company may refuse your registration and may terminate your password, account (or any part thereof), or use of the Member Service, and may also remove and delete any “Member Content” in the Member Service. In addition, you agree that if the use of the Member Service is terminated, OPENPOINT shall have no obligation to bear any liabilities for you or any third party.
15. The Company ensures that the OPENPOINT service computer system is equipped with security satisfying general and reasonable expectations;
however, for services or webpage contents linked to the Member Service and provided by the corresponding service or webpage operators, the Company provides no guarantee on the accuracy, credibility, or timeliness of the content or information provided by such services or webpages.
16. Governing Law and Interpretation Principle
The interpretation and applicability of these Terms of Use and any disputes related to these Terms of Use shall be governed by the local laws, and interpretations in favor of the consumers shall be adopted. In addition, the Taiwan Taipei District Court is recommended to be the competent court of first instance.

OPENPOINT United Point Collection Service Rules:
Applicant hereby agrees with the following terms and conditions:
  1. Applicant joining the OPENPOINT United Point Collection is entitled to OPENPOINT points (referred to as the “Points”) provided by President Chain Store Corporation (referred to as “President Chain Store”), all OPENPOINT Alliance Enterprises (referred to as “Alliance Enterprises”), and contracted cooperating stores (the list of Alliance Enterprises and contracted cooperating stores will be updated and announced on the OPENPOINT website and APP irregularly, please refer to the OPENPOINT website and APP for further details) as gifts, and the Applicant may accumulate Points to redeem special offers or gift products provided by President Chain Store, Alliance Enterprises, and contracted cooperating stores, and may also use the Points to receive the services of marketing special offers provided by President Chain Store, Alliance Enterprises, and contracted cooperating stores.

  2. To ensure the personal rights and interests, the Applicant is required to provide correct personal data. In the case of any change of the personal data, the Applicant must update immediately in order to maintain the accuracy of the system records and data. The Applicant shall not misappropriate the identity of others to perform application; otherwise, the Applicant shall bear relevant civil and criminal legal liabilities solely. President Chain Store will use the basic information recorded in the present application form or registered in the most recent system login of President Chain Store as the record basis. President Chain Store will transmit information and emails irregularly with the address, mobile phone, or email and account information, etc. recorded in the system, in order to provide member Points accumulation activity and special offer information. If any reward or prize is won by the Applicant during relevant activities, President Chain Store will also inform the Applicant via email actively. Accordingly, to ensure your rights and interests, please be sure to provide proper data and maintain the accuracy of the data.

  3. Each Applicant is limited to the application of one account only (the account may be used to register twenty icash2.0 second generation cards, and the OPEN WALLET mobile payment wallet can be used to bind twenty credit cards). In the case of any violation, the Company may terminate the member identity, and the violator may also be requested to return all benefits previously obtained (including but not limited to Points and gift products).

  4. President Chain Store, Alliance Enterprises, contracted cooperating stores, and service providers entrusted by President Chain Store may, during the OPEPOINT point collection carrier operation period, and within the reasonable scope of specific purposes of “157 Survey, Statistics and Research Analysis”, “040 Marketing”, “090 Consumer and Customer Management and Service”, “091 Consumer Protection”, “081 Personal Data Legal Transaction Business”, “181 Other business needs complying with the business registration items or specified in the articles of incorporation”, collect, process, and use basic information including but not limited to member name, telephone, address, and date of birth as well as daily consumption related activity data of member purchase time, purchase statements, store location, invoice number, card number, and Points, etc. via the methods of statistical analysis, cross comparison, text messages, activity information broadcast, mail, email, survey, telephone marketing, and telephone service. However, in the case where a member expresses that he/she does not agree to the above or requests to stop of the provision of the aforementioned services, President Chain Store, Alliance Enterprises, contracted cooperating stores, and service providers entrusted by President Chain Store will stop the provision of the services immediately, and the rights and interests of the member will not be affected.

    President Chain Store, Alliance Enterprises, and contracted cooperating stores may provide the Points data of members to cooperating partners, in order to be used for the contracted stores point accumulation operation, notice of Points balance, statistical survey and analysis, cross comparison, marketing, and other services, provided that President Chain Store shall provide data within the necessary scope only and shall also implement appropriate personal data protection on the members’ data. After a consumer applies for membership on the OPENPOINT website or APP and completes the activation procedure with the confirmation of the text messages sent by President Chain Store via mobile phone, he/she then becomes a member of the OPENPOINT Group. The account number of a member of the OPENPOINT Group is the mobile phone number, and when the member activates the OPENPOINT Group member account, he/she may then use the services provided by OPENPOINT.

  5. To protect the rights and interests of members, in the case where the system has any abnormality in the Points registration, President Chain Store may suspend the Points registration and redeem function of the card subject to abnormality. After the abnormality is resolved, President Chain Store may then restore the member Points registration and redeem function in a timely manner or may adjust the Points of the card.

  6. When a member returns or exchanges product or service previously purchased along with the collection of Points as gifts to the original Alliance Enterprise or contracted cooperating store, the Alliance Enterprise and contracted cooperating store may deduct the Points previously provided for the product. If the balance of the Points is insufficient for the deduction, the Alliance Enterprise and contracted cooperating store shall have the right to request the member to make a compensatory payment in cash at an amount equivalent to the number of insufficient Points.

  7. The gift contents available for redemption with the Points are updated irregularly, and members shall not request to redeem Points for cash or to redeem gift products that are not available during the gift redemption period. The point redemption operation shall follow the announcements published by the Alliance Enterprises and contracted cooperating stores in principle.

  8. Unless further terms and conditions are specified, President Chain Store and contracted cooperating stores are not in the relationship of partnership, dealership, agency, or guarantor. When a gift product redeemed is provided by a contracted cooperating store to members directly, all issues related to the mailing, use, guarantee, warranty against defect, etc., shall be handled and resolved by the contracted cooperating store or activity hosting unit individually.

  9. Points received by members for the current year may be valid for use until the date of December 31 of the following year. Points received from the participation of marketing activities are to be transferred into the member accounts during the period further designated for each activity, and the Points required for gift redemption are to be deducted in advance before the gift delivery date.
